Terms of Service

Chapter 1 General Provisions

Article 1 (Purpose)

These Terms and Conditions aim to define the rights, obligations, and responsibilities of Ostbig inc. (hereinafter referred to as the "Company") and the user (hereinafter referred to as the "Member") in using the website and related services (hereinafter referred to as the "Service") operated by the Company.

Article 2 (Definitions)

1. "Company": Refers to the business entity providing the Service.

2. "Service": Refers to all tangible and intangible activities provided by the "Company" to the "Member," including content, digital products, information provision, and community activities.

3. "Member": Refers to a person who agrees to these Terms and uses the "Service" provided by the "Company."

4. "Content": Refers to all materials such as information, data, videos, images, voices, etc., produced by the "Company" or licensed from a third party and provided to the "Member" through the "Service."

5. "ID" and "Password": Refer to a combination of letters, numbers, special characters, etc., selected by the "Member" and approved by the "Company" for the identification of the "Member" and the use of the "Service."

6. "Paid Service": Refers to various digital content and services provided by the "Company" for a fee.

Article 3 (Specification and Revision of Terms)

1. The "Company" posts the contents of these Terms on the service screen so that the "Member" can easily know them.

2. The "Company" may revise these Terms to the extent that it does not violate relevant laws such as the "Act on the Regulation of Terms and Conditions" and the "Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.".

3. If the "Company" revises the Terms, it shall specify the effective date and the reason for the revision and announce it on the service screen along with the current Terms from 7 days prior to the effective date. However, if the Terms are changed to the disadvantage of the "Member," notice shall be given with a grace period of at least 30 days in advance.

4. If the "Company" announces the revised Terms according to Paragraph 3 and clearly notifies the "Member" that if they do not express their refusal within 30 days from the date of announcement, they will be deemed to have agreed to the change, but the "Member" does not express refusal, it shall be deemed that they have agreed to the revised Terms.

5. If the "Member" does not agree to the application of the revised Terms, the "Company" cannot apply the contents of the revised Terms, and in this case, the "Member" may terminate the use contract.

Article 4 (Relationship with Relevant Laws)

Matters not specified in these Terms shall be governed by relevant laws and service-specific usage policies.

Chapter 2 Service Use Contract and Personal Information Protection

Article 5 (Establishment of Use Contract)

1. The use contract is concluded when a person who wishes to become a "Member" (hereinafter referred to as the "Applicant") agrees to the contents of the Terms, applies for membership, and the "Company" approves such application.

2. The "Company" accepts the application of the "Applicant" in principle. However, the Company may refuse acceptance or terminate the use contract afterwards for applications falling under any of the following subparagraphs.

a. If the applicant has previously lost membership status under these Terms (except where the "Company" has approved re-joining).

b. If another person's name is used.

c. If false information is entered or details required by the "Company" are not entered.

d. If it is confirmed that the application is in violation of these Terms or is illegal or unjust.

Article 6 (Duty to Protect Personal Information)

The "Company" strives to protect the "Member's" personal information as presumed by relevant laws such as the "Act on Promotion of Information and Communications Network Utilization and Information Protection, etc." The protection and use of personal information are governed by relevant laws and the "Company's" Privacy Policy.

Chapter 3 Service Usage

Article 7 (Provision of Service)

1. The "Company" provides the following "Services" to the "Member."

a. "Content" and information provision service

b. Community and social activity service

c. Paid "Content" and product sales service

d. Any other services provided to the "Member" through additional development by the "Company" or partnership with other companies.

2. The use of the "Service" shall be 24 hours a day, 365 days a year in principle. However, the "Company" may temporarily suspend the provision of the "Service" in case of service facility inspection, repair, replacement, breakdown, communication interruption, or significant operational reasons.

Article 8 (Use of Paid Services and Payment)

1. The "Member" must provide the "Company" with the necessary payment method to use the "Paid Service," and the "Company" may request additional information from the "Member" necessary for payment.

2. Details regarding payment and refund of the "Company's" "Paid Service" shall follow a separately determined policy or relevant laws.

Article 9 (Copyright of Content)

1. Copyright and other intellectual property rights for all "Content" provided by the "Company" through the "Service" belong to the "Company."

2. The "Member" shall not use the information obtained by using the "Service" provided by the "Company" for commercial purposes or allow a third party to use it by copying, transmitting, publishing, distributing, broadcasting, or other methods without the prior written consent of the "Company."

Article 10 (Obligations of Members)

The "Member" shall not engage in the following acts.

1. Registering false information or stealing other people's information

2. Changing information posted by the "Company" or copying or distributing it without the "Company's" prior consent

3. Infringing on intellectual property rights such as copyrights of the "Company" and other third parties

4. Damaging the reputation of the "Company" and other third parties or interfering with their business

5. Disclosing or posting obscene or violent messages, images, voices, or other information contrary to public order and morals on the "Service"

6. Other illegal or unjust acts

Chapter 4 Termination of Use Contract and Restrictions on Use

Article 11 (Termination of Use Contract)

1. The "Member" may terminate the use contract at any time by notifying the "Company" of their intent to terminate. However, the "Member" must end the use of all "Paid Services" or complete refund procedures before the termination notice.

2. If the "Member" violates the obligations of Article 10 or commits an act contrary to these Terms, the "Company" may terminate the use contract or restrict the use of the service without prior notice.

Article 12 (Restrictions on Use and Suspension)

If the "Member" violates the obligations of these Terms or interferes with the normal operation of the "Service," the "Company" may restrict the use of the "Service" in stages through warning, temporary suspension, permanent suspension, etc.

Chapter 5 Damages and Others

Article 13 (Damages)

If damage occurs to the other party due to the imputation of the "Company" or the "Member," the party suffering the damage may claim damages from the other party. However, the Company is not responsible for the use of services provided free of charge unless there is a special provision in relevant laws.

Article 14 (Indemnification)

1. The "Company" is exempted from responsibility for the provision of the "Service" if it cannot provide the "Service" due to force majeure such as natural disasters or reasons of a third party such as sanctions by the government or public institutions of each country.

2. The "Company" is not responsible for obstacles to the use of the "Service" due to the imputation of the "Member."

3. The "Company" is not responsible for the reliability and accuracy of information, data, and facts posted by the "Member" in relation to the "Service."

Article 15 (Jurisdiction and Governing Law)

1. Disputes arising between the "Company" and the "Member" regarding these Terms shall be governed by the laws of the Republic of Korea.

2. Lawsuits concerning disputes arising between the "Company" and the "Member" shall be brought to the competent court under the Civil Procedure Act.
